General Information & Conditions

The following terms and conditions form the basis of your booking with Kimberley Outback Tours Pty Ltd (‘KOT’, ‘we’ or ‘our’). Please take the time to read and understand the conditions of booking, set out below.  By asking us to confirm your booking and by payment of your deposit, we assume that you have read these booking conditions, that you agree to and accept our Terms & Conditions as stated below.

Terms & Conditions:

Prices/Deposits/Payments – Prices are quoted in Australian Dollar (AUD). Your booking price will be set out on this website unless it is varied by advertising or a special offer, including without limitation, to cover changes in government taxes and charges, fuel surcharges, a force majeure event or other material increases by suppliers. Once you pay your deposit your tour price is guaranteed (except for any changes resulting from a force or unavoidable accident/event). A deposit of 20% per person, per tour, is required within fourteen days of booking confirmation. Deposit requirements may vary when booking a special offer. Final payment of the balance of your tour price is due 60 days prior to departure unless stated in the terms of a special offer. KOT reserves the right to cancel any ticket or booking or to refuse to carry any passenger where payment has not been received by KOT within the specified time. Payment in full is required at time of booking for reservations made less than 60 days before departure of the tour. A 1.1% surcharge is charged when paying directly with us by Credit card. No charges for EFT payments. Online payments via credit card can be done via our website at a higher surcharge.

Rooms:  Double or Twin Rooms – Accommodation in all Lodges/Camps/Motels, regardless of the rating, is in standard rooms (sometimes named superior/deluxe) based on twins or doubles unless otherwise stated.
Single Travellers – We do not charge a single supplement on our tours, but a limited number of single rooms/cabins may be available by request at time of booking your tour. Single rooms/cabins are usually smaller than the standard twin or double rooms and often only have one single bed.

Health & Mobility/Fitness – We will assume all passengers are in good health and have a reasonable level of fitness and we are not liable for any injury, illness during any activity.  A good level of fitness and health is required to participate in KOT tours. In some destinations, there are sightseeing excursions by foot. Mobility is needed boarding or alighting our busses. It is your responsibility to advise KOT of any pre-existing medical conditions or health and mobility related concerns that may affect the normal conduct of a tour and the enjoyment of other passengers.
Any disability or medical condition requiring special attention must be reported to KOT at the time of booking. KOT is not responsible for any loss of enjoyment, loss of touring or loss of monies should the customer be unable to participate in the tour or in any or all of the activities. Any costs incurred as a consequence of the customer’s need to return home as a result of non-disclosure are the customer’s responsibility. KOT is not liable for any injury, illness, or loss of enjoyment which could have been reasonably prevented had we been made aware of a pre-existing condition. We will not be responsible for any costs associated with cancellation penalties or the return of passengers from a tour, and a refund for lost touring cannot be claimed.

Travel Insurance – Travel Insurance is not included in your holiday package, therefore strongly recommend you to purchase comprehensive travel insurance that includes coverage for the cost of your tour, medical expenses, loss of luggage and land/personal content that may occur due to cancellation, medical emergencies, impossibility of performance, loss of deposit, disruptions or strikes. It is your responsibility to look after your property at all times and you must ensure you are adequately covered by your travel insurance in the event of any loss or damage thereof.

Travel Details & Information – After booking, you will receive an emailed invoice with all important information relevant to your tour. We strongly recommend you check the details carefully and read the information supplied. We will request you to provide us with personal information, hotel pickup/dropoff points, dietary needs and emergency information at the latest 45 days prior to departure.  If any of this information change prior to departure, please notify us of changes at least 21 days before departure. KOT is required by all accommodation facilities to pass on any dietary requests 21-30 days prior to arrival at Lodge/Camp/Motel.

Cancellation Policy – KOT cancellation fees apply:

Notice is given 90 – 61 days prior to departure              –    Loss of deposit
Notice is given 60 – 31 days prior to departure             –    50% of tour price
Notice is given 30 days or less prior to departure          –   100% of tour price
All cancellations must be received in writing by KOT and are not effective until this notification has been received. If your holiday has commenced, 100% of the full tour price is charged. There is no refund if parts of the tours are missed.
No cancellation fees will be waived as a result of:

  • Sickness or injury
  • Delayed, rescheduled or missed flights or connected travelling.
  • Climatic, political or soacial insidents

Booking Extra’s & Luggage – Each passenger is entitled to take one piece of luggage that does not weigh more than 20 kg. A small carry on bag is allowed for storage off sunglasses, camera and precious items to keep with you.  All passenger’s luggage is entirely at their own risk during the duration of the tour.

Seating and Rotation Tours – To ensure all passengers enjoy forward and window facing seats, we recommend a daily seat rotation system.

Smoking – For other passengers’ comfort there is no smoking on coaches or river cruise ships, except in designated areas.

Limitation of Liability – Kimberley Outback Tours do not accept any responsibility or liability for any injury, loss, damage, change of itinerary or inconvenience caused either directly or indirectly as a result of events which are outside of Kimberley Outback Tour’s control.  Kimberley Outback Tours will not be liable for any loss, damage omission or act of negligence or otherwise committed by third parties or other operators, their assignees or agents.
Itineraries are correct at time of publication and may differ slightly to the one displayed in the brochure/website.  Occasionally itineraries chance as operators make changes based on feedback from past travellers or due to weather conditions or accommodation availability.
